Welcome to the tturkish.com Subscription Services! These Subscription Terms articulate the fundamental conditions guiding your use of TTurkish's fee-based subscription services. Our services grant access to an exclusive network of Tutors, allowing you to seamlessly connect with them through the TTurkish Platform. It is crucial to thoroughly review these terms, including the arbitration agreement, as your usage of the services is contingent upon accepting these conditions.

These Subscription Terms form a binding agreement between you and TTurkish, Inc., a corporation registered under the laws of the State of Delaware, with its principal place of business in the USA. It's essential to note that these Subscription Terms work in harmony with the TTurkish Terms of Service, which govern your overall use of the TTurkish Platform. In situations where a conflict arises between the TTurkish Terms of Service and these Subscription Terms, the latter shall prevail.

**1. DEFINITIONS**

​

- **TTurkish Platform:** The technological infrastructure facilitating the connection between Students and Tutors, enhancing the language learning experience.

- **Student (or "you"):** An individual seeking Tutoring Services through the TTurkish Platform.

- **Tutor:** An individual offering Tutoring Services through the TTurkish Platform.

- **Tutoring Services:** The online language teaching and tutoring services provided by Tutors to Students who have subscribed through the TTurkish Platform.

For any capitalized terms not explicitly defined in these Subscription Terms, refer to the definitions outlined in the TTurkish Terms of Service.

**2. SUBSCRIPTION PLANS**

​

**2.1. General Terms**

​

To access our services, you must meet the eligibility criteria specified in the TTurkish Terms of Service, possess internet connectivity, register a TTurkish account, and maintain a valid Payment Method. It is essential not to be prohibited from receiving the services under the applicable laws of your jurisdiction. By accepting these Subscription Terms, you affirm your understanding and agreement with these conditions.

We provide a range of subscription plans, each with distinct pricing, conditions, and limitations. Comprehensive details about each subscription plan can be found on our pricing and checkout pages.

**2.2. Credits**

​

Certain subscription plans or promotional offers include "Credits" – a specified number of hours or lessons. These Credits are redeemable only on the TTurkish services and can be utilized to schedule lessons with a designated Tutor. The remaining Credit balance can be checked through your TTurkish account. If a scheduled lesson is missed by the Tutor, the Credits are refunded. However, if you miss a lesson, the Credits are deemed utilized.

All Credits have a validity period as per the subscription and promotional terms. They expire immediately upon subscription cancellation or termination.

**2.3. Subscribe to a Tutor**

​

This subscription type provides a fixed number of hours per week for scheduling lessons with a chosen Tutor. Credits are replenished every 28 days, with unused Credits expiring, except for 25% of the Credits, which roll over to the subsequent billing cycle.

​

Subscription plans and pricing depend on the hourly rate of the selected Tutor.

​

**2.4. Subscriptions with a Free Trial Period**

​

These subscriptions grant access to paid services for a specified duration without payment. After the trial period, regular charges apply unless you cancel the subscription.

​

3. TRIALS AND PROMOTIONS

​

3.1. Subscribe to a Tutor. Trial Lesson

​

Embark on your language learning journey with TTurkish, and explore our subscription plans designed to connect you with skilled Tutors. Before committing to a subscription, you have the opportunity to purchase a trial lesson with your chosen Tutor. If, for any reason, the Tutor doesn't meet your expectations or the trial lesson doesn't materialize, TTurkish provides options:

• Free Lesson or Refund: Request a free lesson with another Tutor of your choice on the TTurkish platform, or opt for a refund of the payment.

• Tutor Change: Following your first trial lesson, you have the flexibility to change your Tutor twice without additional charges. If you decide to change Tutors more than twice, the subsequent lesson should be paid for.

Once you've experienced the trial lesson(s) and decided on a Tutor, you'll be guided to select a suitable subscription plan. For yearly subscriptions, TTurkish may even offer a 14-day trial period, allowing you to cancel at any time.

​

3.2. Free Trial Period

​

As a special offer, TTurkish occasionally provides trials of paid subscriptions for a specified period without payment, known as a "Free Trial Period." To avoid charges after this period, cancel your subscription at least one day before it concludes. Free Trial Periods are exclusively available for first-time users, with eligibility limited to one Free Trial Period. TTurkish reserves the right to suspend or terminate accounts in violation of these terms.

If a Tutor doesn't meet expectations during the trial or the lesson doesn't occur, users can request a free trial lesson with another Tutor of their choice. Changing Tutors within the Free Trial Period is allowed up to two times, with the condition that the new lesson is scheduled within this period. Beyond two changes, subsequent lessons, even if scheduled during the Free Trial Period, will incur charges.

3.3. Promotions

​

Explore the diverse world of language learning with TTurkish through occasional promotional offers and plans. Promotion eligibility is determined by TTurkish at its sole discretion, and the terms and conditions are detailed in the TTurkish Promotional Terms & Conditions. TTurkish reserves the right to revoke a Promotion and place accounts on hold if eligibility criteria are not met.

4. BILLING, RENEWAL, AND CANCELLATION

​

4.1. Subscription Fee

​

After a paid trial lesson or a Free Trial Period, users are required to pay the applicable monthly, quarterly, or annual Subscription Fee. Unless canceled before the trial or subscription period ends, users authorize TTurkish to charge the Subscription Fees for the next billing cycle to their Payment Method. If funds are insufficient, renewal attempts will be made for up to 30 days until funds are available.

4.2. Billing Cycle

​

The Subscription Fee and associated charges, including taxes and transaction fees, are billed to the Payment Method on the specified date. The billing cycle duration depends on the chosen subscription plan, with possible changes under certain circumstances.

​

4.3. Auto-Renewal

​

For uninterrupted learning, subscriptions automatically renew unless canceled at least one day before the end of the billing cycle.

​

4.4. Adding Hours (Top-Ups)

​

Users can enhance their learning experience by topping up their account balance with additional hours beyond their subscription plan. These top-ups, capped at 8 hours each, don't affect the subscription plan but provide flexibility within the current billing cycle. The added hours expire along with unused Credits at the end of the billing cycle.

4.5. Upgrades and Downgrades

​

Enhance your language learning experience with TTurkish by exploring our flexible subscription options. Throughout your subscription period, you have the ability to upgrade or downgrade your plan, providing you with greater control over your learning journey:

​

• Subscribe to a Tutor Upgrades: Increase your monthly subscription for more hours per week, and TTurkish will seamlessly adjust your billing cycle. You'll continue to utilize the remaining Credits from your previous monthly subscription plan until the next billing date. While upgrades and downgrades are currently not available for yearly subscription plans, TTurkish will keep you informed once this feature becomes accessible. Manage your subscription effortlessly under the "Manage your subscription" section on your account's "Settings" page.

• Immediate Plan Changes: Upgrade plans, and the applicable Subscription Fee will take effect immediately. Downgrades will apply on the next billing date.

4.6. Payment Methods

​

To unlock the full potential of our services, you need to provide one or more Payment Methods. TTurkish is authorized to charge any associated Payment Method if the primary one is declined or unavailable. You remain responsible for any uncollected amounts. For some Payment Methods, additional fees may be charged by the issuer.

4.7. Updating your Payment Methods

​

Stay in control by updating your Payment Methods through your account's "Settings" page. Following any update, TTurkish is authorized to continue charging the applicable Payment Method(s).

​

4.8. Changing Renewal Date

​

Tailor your learning schedule by postponing your monthly subscription plan's renewal date by up to 20 days in each billing cycle. Follow the instructions in the "Manage your subscription" section of your account's "Settings" page to make this change. The Credits included in your chosen subscription plan will be refilled every 28 days from the new renewal date.

4.9. Subscription Cancellation

​

Flexibility is key, and you can cancel your subscription at any time before your next billing date by navigating to your account's "Settings" page. While unused Credits included in your subscription plan expire at the end of the billing cycle, you'll still retain access to scheduled lessons until the current subscription period concludes.

4.10. Lesson Rescheduling and Cancellation

​

Navigate lesson rescheduling and cancellations with ease. The cancellation policy, as outlined on the My Lessons page and during the booking process, determines the process. A reason for cancellation may be required, forwarded to your Tutor in most cases. TTurkish reserves the right to charge for lessons canceled or rescheduled outside the specified timeframe.

4.11. Non-refundable Payments

​

In alignment with applicable laws, payments are generally non-refundable. No refunds are provided for partial subscription periods or unused Credits. However:

​

• Subscribe to a Tutor: Monthly Subscription Plan: A refund may be processed if no Credits have been used within the current subscription period, provided the payment was made less than 28 days ago.

• Subscribe to a Tutor: Yearly Subscription Plan: Refunds are available within the 14-day trial period if no Credits have been used. For cancellations after the trial period, no refund is applicable, and the balance of Credits continues to be refilled every 28 days until the subscription ends. Refund requests can be sent to support@tturkish.com, subject to TTurkish's sole discretion.

4.12. Changes to the Subscription Plans and Pricing

​

TTurkish reserves the right to modify subscription plans and Subscription Fees, with such changes taking effect upon subscription renewal. Students will be notified in advance, providing an opportunity to cancel the subscription if the changes are not agreeable.

5. TTURKISH SERVICES

​

By registering for an account, you commit to providing accurate, complete, and updated information. Account credentials are for personal use only, and you are responsible for all activities and maintaining password confidentiality. TTurkish services must be used in accordance with applicable laws, rules, and regulations. Users are granted limited access during the subscription period, subject to compliance with outlined terms and conditions. No transfer of right, title, or interest occurs except as expressly authorized.

6. SUSPENDING AND TERMINATING THE TTURKISH SERVICE

• Termination and Suspension: These Subscription Terms will continue to apply to you until either you or TTurkish decides to terminate them. TTurkish holds the right to terminate these Subscription Terms or suspend your access to our services under various circumstances:

  • Breach of Terms: In case of suspicion of a breach of these Subscription Terms.

  • Harassment or Illegal Activities: Instances involving sexual or unwelcome harassment, threats, intimidation, or engagement in illegal or fraudulent activities.

  • Service Discontinuation: If TTurkish decides to discontinue the services or any significant component thereof.

  • Legal Compliance: As deemed necessary to comply with applicable laws.

• Consequences of Termination: Upon termination by either party, or if access is suspended, you agree that TTurkish shall have no liability or responsibility to you. Except as expressly provided in these Subscription Terms, there will be no refund of any amounts already paid. You retain the option to terminate these Subscription Terms at any time by discontinuing your use of TTurkish services and providing a termination notice to TTurkish or deleting your account.

7. TTURKISH AS AN ON-DEMAND INTERMEDIARY

Navigate the language learning landscape with confidence, understanding TTurkish's crucial role as an on-demand intermediary connecting Students and Tutors and providing tools that facilitate Tutoring Services. It's essential to recognize that TTurkish acts as a technology services provider and does not directly offer online tutoring services or function as a language learning school.

8. PERSONAL DATA

Rest assured that TTurkish values your privacy. The processing of your personal data is conducted in accordance with our Privacy Policy. Your data's security and confidentiality are paramount as you embark on your language learning journey.

9. LIABILITY

​

• Disclaimer: TTurkish services are provided "as is" and "as available" without any warranties, express, implied, or statutory. TTurkish does not represent, warrant, or guarantee that your access to or use of TTurkish services will be uninterrupted or error-free. As an on-demand intermediary, TTurkish disclaims any representations, warranties, or guarantees regarding Tutors' acts or omissions. To the fullest extent permitted by law, TTurkish is not liable for any damages, losses, or costs arising from the use or misuse of our services.

• Limitation of Liability: TTurkish's total cumulative liability under these Subscription Terms or its services, whether in contract, tort, or otherwise, shall not exceed the Subscription Fees paid in the preceding three months. This limitation safeguards your language learning journey from unforeseen circumstances.

• Waiver of Class Action: Both you and TTurkish agree that any claims must be brought individually, and neither party can bring claims as a plaintiff or class member in a class or representative proceeding. This ensures fairness and clarity in dispute resolution.

10. INDEMNIFICATION

As a user, you commit to indemnify, defend, and hold TTurkish and its affiliates, along with their officers, directors, employees, agents, successors, and assigns, harmless from any liabilities, damages, losses, and expenses arising from your breach of these Subscription Terms, activities on TTurkish services, or violations of laws or third-party rights. 11. AMENDMENTS TO THESE SUBSCRIPTION TERMS

Stay informed about changes as TTurkish reserves the right to amend these Subscription Terms. Regularly check for updates, and if you disagree with amendments, you have the right to terminate these Subscription Terms by discontinuing your use of TTurkish services or deleting your account. 13. DISPUTE RESOLUTION

Resolve disputes effectively with the outlined procedure:

• Arbitration: Disputes arising out of consumer claims will be resolved by individual arbitration in Delaware, USA, conducted in English under the Commercial Arbitration Rules of the American Arbitration Association (AAA).

• Scope: The arbitration applies to individual claims only, and both parties waive the right to resolve disputes through court on a class, collective, or representative basis.

• Costs: Parties share arbitration costs equally, with potential adjustments based on unique arbitration costs. The prevailing party may be entitled to reasonable attorneys' fees and costs.

• Finality: Arbitration decisions are final and enforceable, with temporary injunctive relief available to TTurkish in specific situations. This process ensures a fair and structured resolution mechanism.

The TTurkish services should not be employed for soliciting any other business, website, or service. Tutors are here to facilitate your learning journey, and any attempts to solicit, advertise, or contact them for purposes unrelated to the services provided by TTurkish require express written permission. Additionally, the services should not be utilized to collect Tutors' usernames and/or email addresses through electronic or other means without the explicit prior written consent of TTurkish. These guidelines maintain the integrity of the learning platform.

16. SEVERABILITY

We recognize the dynamic nature of legal agreements, and in the event that any provision of these Subscription Terms is deemed unlawful, void, or unenforceable, rest assured that a solution is in place. The affected provision will be considered severable, preserving the validity and enforceability of the remaining provisions. The parties involved will work towards replacing the affected provision with an enforceable one that best aligns with the original intent and economic effect. This provision ensures adaptability and continuity.
